Thank you for your efforts past and present on storm recovery for towns and state infrastructure projects.
As you are likely aware, the Governor issued an updated EO 03-23 to address the recent and ongoing flooding across the state. This includes regulatory relief from Act 250 permitting requirements.
What you need to know:
- Follow the detailed guidance here: nrbSS2024_Emergency_Instructions.pdf (vermont.gov)
- Fill out the attached form and submit to: NRB.general@vermont.gov now.
- Certain operations do not need an Act 250 permit or amendment to operate under the Emergency Order.
- Emergency Order applies to:
- Asphalt and Concrete plants, gravel pit and quarrying operations
- For materials to towns or the state for recovery efforts
- Emergency Order requires compliance with permitting requirements by or before November 15, 2024
- Winter stabilize by November 15, 2024; reclaim by May 15, 2025, and submit documentation by June 15, 2025.
